These Terms & Conditions govern all projects and services provided by MontyCora (“I”, “me”). By working with us, you (“the client”) agree to the following:
1. Scope of Work
The scope of each project will be defined in a written proposal. Any work requested outside the agreed scope (e.g., additional pages, features, or revisions) will be billed separately at the standard hourly rate of $25/hr unless otherwise agreed.
2. Payment Terms
- Projects are billed in milestones: 40% upfront to book, 40% upon design approval, and 20% before launch.
- Pay-in-full option: 5% discount.
- All invoices are due within 7 days of receipt.
- Late payments may result in work being paused until payment is received.
3. Timeline Policy
Timelines listed in packages or proposals refer to development time only (after final design approval and receipt of all content). Design phases and client feedback cycles vary and may extend the overall duration.
Delays in providing content, feedback, or approvals will push back delivery dates. Launch dates are target estimates, not guarantees.
4. Client Responsibilities
To keep projects on schedule, clients agree to:
- Provide content (text, images, branding assets) in a timely manner.
- Respond to feedback/review requests within 5 business days.
- Ensure all materials provided are licensed for use.
5. Intellectual Property & Code License
- All design assets (layouts, color systems, typography choices, images created specifically for your site) and website content created for your project are transferred to you upon final payment.
- The underlying MontyCora theme framework and custom block system remain the intellectual property of MontyCora.
- You are granted a permanent, non-exclusive license to use this codebase on your website. This license is limited to your project only and may not be resold, redistributed, or reused for other projects without written permission.
6. Revisions
Each project includes a set number of revision rounds as defined in the proposal. Additional revisions beyond that will be billed at the hourly rate.
7. Care Plans & Hosting
- Care Plans are billed monthly and cover the services listed in the plan description. Unused services expire at the end of each billing month and do not roll over.
- Hosting is billed separately at $6/month. Hosting is provided via a third-party provider (HostGator). MontyCora manages the setup, monitoring, and first-line support, but cannot be held liable for outages, downtime, or issues caused directly by the hosting provider.
8. Liability
I am not liable for:
- Losses due to hosting outages, third-party service interruptions, or hacking.
- Loss of revenue, data, or reputation resulting from website downtime.
- Content provided by the client (you are responsible for ensuring it does not infringe third-party rights).
9. Termination
Either party may terminate a project with written notice. Work completed up to the date of termination will be billed accordingly. Deposits are non-refundable once work has begun.
10. Governing Law
These Terms & Conditions are governed by the laws of Brazil. Any disputes will be resolved under Brazilian jurisdiction.
